Copyright infringement is a crime only in limited situations. Criminal infringement will be found only if there is evidence that the infringing party seeks to obtain financial gain from the copying and there is evidence of large income received from the illicit activities. Criminal infringement includes the following activities:
(1) Reproduction and distribution of another person's work, including documents, manuscripts, musical scores, cinematography production, computer software, and other forms of written media, without the permission of the copyright owner;
(2) Publication of a book to which another person or entity enjoys the exclusive publishing rights;
(3) Reproduction and distribution of an audio or video recording without the permission of the copyright holder; and,
(4) Production and sale of a work of art without the permission of the copyright owner.
The penalty for criminal copyright infringement is a prison term of not more than three years and the imposition of a monetary fine.
