The Criminal Law states that it is a crime to use a trademark identical to a registered trademark on the same type of merchandise without the permission of the registered owner. It is also a crime to sell merchandise with knowledge that it depicts a counterfeit registered trademark on any type of merchandise. The law further provides that it is unlawful to manufacture any representation of a registered trademark without permission of the registered owner. A person who violates the law is subject to imprisonment of infringement or where the sales volume of infringing goods is relatively large; the term of imprisonment may be from three to seven years. In addition to imprisonment, a violation may result in the imposition of monetary penalties.
