3. How does the new TMO deal with the Well-Known Marks?

The new TMO includes provisions to reflect Article 6 of the Paris Convention protecting well-known marks ("WKM"), and relative grounds of refusal of a trademark include where the mark applied for is
- identical to a WKM and is for identical goods/services; or
- identical to a WKM, for similar goods/services, and there is a likelihood of confusion.; or
- similar to a WKM, for identical or similar goods/services, and there is a likelihood of confusion.
