Who bears the costs of infringement litigation, the owner or the licensee?

Only a patent holder or an exclusive licensee has standing to sue for infringement. A nonexclusive licensee will want the patent owner to commit explicitly to defend the licensee from infringers. The details of this commitment should be spelled out in the licensing agreement.
